Below is a list of services covered for qualified members under your legal plan:
• Legal advice, research, consultation and document preparation and review.
• Drafting and execution of wills.
• Drafting and execution of Powers of Attorney and Trust Agreements.
• Probate of Wills and administration of estates of deceased Employees, Pensioners or their spouses.
• Uncontested divorce, separation or annulment proceedings, subject to a 30 hour limit per fiscal year (March 1 – February 28). Once service has been undertaken on behalf of the Participant, the Spouse shall receive no assistance concerning the matter.
• Uncontested adoptions.
• Change of name proceedings.
• Purchase or sale of real estate, refinance and/or family transfer involving a Participant’s residence, vacation or retirement home.
• Examination of leases in instances where the Participant, Spouse or Dependent Child is the prospective tenant.
• Suits against Participant, Spouse or Dependent Child for rent.
• Tenant defense in eviction proceedings.
• Personal voluntary petition in bankruptcy (not involving any business) and related services in the Bankruptcy Court including discharge.
• Representation in civil litigation (excluding claims under Small Claims Court jurisdiction or matters normally handled on a contingent fee basis), subject to a 30 hour limit per fiscal year (March 1 – February 28).
• Defense in civil litigation (excluding claims under Small Claims Court jurisdiction or matters covered by insurance), subject to a 30 hour limit per fiscal year (March 1 – February 28).
• Reviewing retail credit and other consumer contracts.
• Tax advice, excluding the preparation of tax returns.
• Civil actions relating to the supervision or revocation of a driver’s license.
• Defense of erroneous hospital or surgical expense claims other than those involving the Local 282 Welfare Fund.
• Defense of erroneous garnishment.
• Basic economic loss claims under no-fault coverage.
• Representation in criminal matters from arrest through arraignment in state and local courts.
• Guardianship proceedings.
• Drafting and execution of health care proxies and living wills.
• Representation in traffic matters where suspension or revocation of a driver’s license is possible.
There is a 30 hour limit per fiscal year (March 1 – February 28) in uncontested divorce, separation or annulment proceedings and civil litigation.
The Summary Plan Description (SPD) for the Legal Services Trust Fund sets forth those items not covered, eligibility requirements for the benefit, and your rights under ERISA.
